1. Introduction
AWA Clothing AI ("we," "us," or "our") is committed to protecting your privacy. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you use our AI-powered clothing design platform.
2. Information We Collect
2.1 Account Information
When you create an account, we collect:
- Name and username
- Email address
- Password (encrypted and hashed)
- Profile information (if provided)
2.2 Authentication via Third Parties (Google OAuth)
If you sign up or log in using Google, we receive:
- Your Google account email address
- Your name as provided by Google
- Google user ID (for authentication purposes)
We do not have access to your Google password. Google's privacy policy governs their data collection and use.
2.3 Usage Data
We automatically collect certain information when you use our services:
- AI-generated images and design requests
- Subscription and payment information
- Device information (browser type, operating system)
- IP address and location data
- Cookies and similar tracking technologies
2.4 AI-Generated Content
When you use our AI clothing design services, we collect and store:
- Text prompts and design requests
- Generated images and mockups
- Design preferences and settings
- Usage patterns to improve our AI models
2.5 Manufacturer Directory Information
If you list your business in our manufacturer directory, we collect and publicly display the information you provide for your listing, which may include:
- Company or brand name and description
- Location (such as city and country)
- Contact details you choose to provide (such as contact name, phone number, or website)
- Product categories, services, and any certificates or documentation you submit
This listing information is visible to other users of the platform. We also collect aggregate analytics about listings — such as how many times a listing is viewed and how many users click to contact a manufacturer — which we use to provide statistics to the listing owner and to improve the directory. Please note that our review of manufacturer listings is limited; details of how the directory works and the limits of our responsibility are set out in our Terms of Service.
2.6 Security, Fraud-Prevention and Payment Records
To keep accounts secure, prevent fraud and handle payment disputes (chargebacks), we keep the following records:
- Account activity: registration, logins, opening and submitting a checkout, cancelling a subscription and opening a support ticket — each with the date and time, your IP address, the approximate country derived from it, and your browser and device type
- Checkout consent: when you subscribe, the version and exact wording of the terms you accepted, the price and renewal date shown to you, and the IP address, country, device and time of your acceptance
- AI generations: the IP address and browser and device type from which each generation was requested
- Emails: a record of the service emails we send you (type, subject, date and whether our mail server accepted them), not their full content
We use these records only for security, fraud prevention and payment disputes — never for advertising or profiling. We process them on the basis of our legitimate interest in protecting our service and our customers (Art. 6(1)(f) GDPR and the Swiss Federal Act on Data Protection).
3. How We Use Your Information
We use your personal information for the following purposes:
- Provide Services: To create your account, process requests, and deliver AI-generated clothing designs
- Improve AI Models: To train and enhance our machine learning algorithms (anonymized when possible)
- Communication: To send verification emails, service updates, and important notifications
- Subscription Management: To manage your plan, process payments, and track usage limits
- Security: To protect against fraud, unauthorized access, and abuse
- Payment Disputes: To document account activity and consent when responding to chargebacks and other payment disputes
- Analytics: To understand how users interact with our platform and improve user experience
- Legal Compliance: To comply with applicable laws and regulations
4. Data Sharing and Disclosure
We do not sell your personal information to third parties. We may share your data only in the following circumstances:
- Service Providers: With trusted third-party providers (hosting, email services, payment processors) who assist in operating our platform
- Payment Disputes: With our payment processors (Stripe, PayPal) and, through them, your card issuer — limited to the records needed to respond to a payment dispute opened on your account
- Legal Requirements: When required by law, court order, or government request
- Business Transfers: In connection with a merger, acquisition, or sale of assets
- With Your Consent: When you explicitly authorize us to share your information
Important: We never share your AI-generated designs with third parties without your explicit permission.
5. Cookies and Tracking Technologies
We use cookies and similar technologies to:
- Remember your login session and preferences
- Analyze site traffic and usage patterns (via Google Analytics)
- Improve user experience and personalization
You can disable cookies in your browser settings, but this may limit some functionality of our platform.
6. Data Retention
We retain your personal information for as long as necessary to:
- Provide our services to you
- Comply with legal obligations
- Resolve disputes and enforce our agreements
Security, fraud-prevention and payment records (see section 2.6) are kept for 12 months after the last payment on your account — or, if you never made a payment, for 12 months after they were recorded — and for as long as you have an active subscription. After that they are deleted automatically, or the IP address and device information are removed. Payment and invoice records are kept for as long as accounting law requires (in Switzerland, 10 years).
If you delete your account, we will delete or anonymize your personal data within 90 days, except where we are required to retain it by law or still need the records described above to handle a payment dispute within the period stated.
7. Your Privacy Rights
You have the following rights regarding your personal data:
- Access: Request a copy of the personal information we hold about you
- Correction: Update or correct inaccurate information
- Deletion: Request deletion of your account and personal data
- Data Portability: Request your data in a machine-readable format
- Opt-Out: Unsubscribe from marketing communications
- Withdraw Consent: Revoke consent for data processing where applicable
To exercise these rights, please contact us at awa@2be.am.
8. Data Security
We implement industry-standard security measures to protect your data, including:
- SSL/TLS encryption for data transmission
- Encrypted password storage using bcrypt hashing
- Secure database hosting with access controls
- Regular security audits and updates
However, no system is 100% secure. We cannot guarantee absolute security of your data.
9. Third-Party Services
Our platform may integrate with third-party services:
- Google OAuth: For authentication (Google Privacy Policy)
- Google Analytics: For website analytics
- Payment Processors (Stripe, PayPal): For subscription billing and payment disputes
- IP Geolocation (ipinfo.io): To determine your approximate country from your IP address, for showing prices in your currency and for the security records described in section 2.6
These services have their own privacy policies, and we encourage you to review them.
10. Children's Privacy
Our services are not intended for children under 13 years of age. We do not knowingly collect personal information from children. If you believe we have collected data from a child, please contact us immediately.
11. International Data Transfers
Your information may be transferred to and processed in countries outside your residence, including Switzerland and the European Union. We ensure appropriate safeguards are in place to protect your data in accordance with this Privacy Policy.
12. Changes to This Privacy Policy
We may update this Privacy Policy from time to time. We will notify you of significant changes by:
- Posting the updated policy on this page
- Updating the "Last Updated" date
- Sending an email notification (for material changes)
Your continued use of our services after changes constitutes acceptance of the updated policy.
